Accessing our web site

Access to our web site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our web site without notice. We will not be liable if for any reason our web site is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of our web site, or our entire web site.

If you are under the age of 18, you may not use the services on our web site. We reserve the right to refuse to offer the services to any person or entity and change eligibility criteria at any time. Where these Terms or Use of the services is prohibited or conflicts with any applicable law, rule or regulation, the right to access the services is revoked.

You are responsible for making all arrangements necessary for you to have access to our web site. You are also responsible for ensuring that all persons who access our web site through your internet connection are aware of these terms, and that they comply with them.

Acceptable use

When using our web site, you shall not:

  • interfere with the proper working of the services we provide or any activities conducted on the services;
  • attempt to bypass or circumvent any measures we may use to prevent or restrict access to the services;

  • harvest or scrape any Content from the services; or
  • otherwise take any action in violation of our guidelines and policies.

  • decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the services, except to the limited extent applicable laws specifically prohibit such restriction;
  • modify, translate, or otherwise create derivative works of any part of the services; or
  • copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder.

You shall abide by all applicable local, national and international laws and regulations.

Viruses, hacking and other offences

You must not misuse our web site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our web site, the server on which our web site is stored or any server, computer or database connected to our web site. You must not attack our web site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our web site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our web site or to your downloading of any material posted on it, or on any website linked to it.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

We do not control these websites and are not responsible for their data or privacy practices. You are advised to review any privacy policy posted on any web site you visit before using the web site or providing any Personal Data about yourself.

We are the owner or the licensee of all intellectual property rights in our web site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

We grant to each user a license to use content solely for purposes of using the web site in accordance with these Terms.

You may print off one copy, and may download extracts, of any page(s) from our web site for your personal reference and you may draw the attention of others within your organisation to material posted on our web site.

Reliance on information published

Information, commentary and other materials posted on our web site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our web site, or by anyone who may be informed of any of its contents.

This web site changes regularly

We aim to update our web site regularly, and may change the content at any time. If the need arises, we may suspend access to our web site, or close it indefinitely. Any of the material on our web site may be out of date at any given time, and we are under no obligation to update such material.

Web site status

The web site is a marketplace for teachers to interact with web site users. We do not search for, select or introduce teachers and students to each other. As a result, we are not regulated under employment law and in the UK the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003 or other employment agency laws.

The Drum Teacher Map is owned and operated by drum teachers and the drumming community. As such it does not currently operate as a limited company and is not registered for VAT. All teachers advertising their services on the web site expressly warrant that they are individual sole traders and are responsible for their own tax and financial affairs.

Our liability

We try to keep the web site running at all times, but we cannot guarantee to do so. We cannot guarantee continuous, uninterrupted or secure access to the web site as it may be interfered with by factors outside of our control.

We also try to make sure that all the information that we place on the web site is accurate, but we cannot guarantee this either.

We use techniques that aim to verify the accuracy of the information provided by teachers, however user verification on the internet is difficult. We cannot and do not confirm, and are not responsible for ensuring, the accuracy or truthfulness of teachers purported identities or the validity of the information which they provide to us or post on the web site

Where the term “Verified” is used on a teacher’s listing, the statement above holds true. Verified status is awarded to teachers that provide references that can be independently verified as far as is reasonably practicable but we cannot be held liable for misrepresentations or deceptive statements made by those intent on deceiving us or web site users. It is impossible to be certain that any teacher has not modified their content after being awarded the “verified” badge. A “verified” teacher only indicates that the teacher has at one point in time been verified and does not guarantee continuous verification or accuracy of the teacher’s listing on an on-going basis.

We do not control any information provided by Users or Teachers that is placed on the web site. We take reasonable steps to monitor information that is posted on the web site.

To the extent permitted by law, we and all third parties connected to us hereby expressly exclude:

A) All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
B) Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our web site or in connection with the use, inability to use, or results of the use of our web site, any websites linked to it and any materials posted on it, including:

  • loss of income or revenue;
  • loss of business;
  • loss of profits or contracts;
  • loss of anticipated savings;
  • loss of data;
  • loss of goodwill;
  • wasted management or office time; and
  • whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

Information about you and your visits to our web site

We process information about you in accordance with our Privacy Policy. By using our web site, you consent to such processing and you warrant that all data provided by you is accurate.

Transactions conducted through our web site

Agreements regarding the supply of services, goods or information formed through our web site or as a result of visits made by you are governed by our Terms of Booking.

Governing Law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our web site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These Terms of Use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

We may revise these Terms of Use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you.
